Jimmie J. Payne, Jr., whose last known place of residence is 1232 W. Galbraith Rd., Apt. #1, Cincinnati, OH 45231, otherwise whose place of residence is unknown, will take notice that on September 4, 2016 the undersigned The General Insurance filed its Complaint in the Court of Common Pleas of Hamilton County, Ohio, Case No.: A-1605093 alleging that on October 5, 2014, and at all times material herein, Plaintiff insured the Defendant pursuant to a policy of liability insurance/SR22 Bond, a copy of which is attached as Exhibit A. On October 5, 2014, the Defendant allowed Carlette Cavanaugh to drive his vehicle, despite Ms. Cavanaugh having a suspended driver’s license. Ms. Cavanaugh negligently operated Defendant’s motor vehicle in such manner so as to cause damage, loss and bodily injury to Janice Reed, Brandy Cornett and Lethia Bullups. Pursuant to the terms and conditions of the attached insurance policy/SR22 Bond, the Plaintiff paid the sum of $12,039.22 to Janice Reed, the sum of $9,500.00 to Brandy Cornett and the sum of $25,000.00 to Lethia Bullups, thereby extinguishing the liability of Jimmie J. Payne, Jr. arising out of the accident of October 5, 2014. Pursuant to the terms and conditions of the attached insurance policy/SR22 Bond, the Defendant is required to reimburse Plaintiff to the extent of its payments made to Janice Reed, Brandy Cornett and Lethia Billups, because the aforesaid insurance policy/SR22 Bond was certified to the State of Ohio pursuant to the financial responsibility laws of the State of Ohio. Specifically, the policy states:
“If we certify this policy as proof of future financial responsibility, this policy will comply with the minimum requirements of the financial responsibility laws as amended, to the extent required for bodily injury and property damage. You or an insured person must reimburse us for any payment we make which we would not have made under the terms of this policy except for it being certified.” (Page (11) of Exhibit A).
The attached policy provides specific exclusion for the operation of any vehicle does not have a driver’s license. See Exhibit A, Page 10. As such, Plaintiff would not have been required to pay the aforementioned damages, but for the certification of this policy as proof of financial responsibility. Pursuant to the terms of the policy, Defendant is required to reimburse Plaintiff the total sum of Plaintiff’s payments.
Wherefore, Plaintiff demands judgement against the Defendant in the amount of $46,539.22, plus the costs of this action.

The Defendant named above is required to answer the complaint of the Plaintiff on or before 16th day of August, 2017.
